Terms & Conditions

1. Who we are

CaptivSite Leads ("CaptivSite," "we," "us," or "our") is a software-as-a-service tool that helps digital marketing agencies, freelancers, and consultants ("Customer," "you") discover, organize, and export local business contact information for sales and marketing outreach purposes.

2. Acceptance of these terms

By accessing or using CaptivSite Leads (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. The Service

CaptivSite Leads provides search, filtering, organization, export, and CRM-integration functionality for business contact data aggregated from publicly available sources. Access is currently provided on a by-invitation, custom-pricing basis, arranged directly between you and CaptivSite, and billed separately through our payment processor.

4. Accounts and access

  • Accounts are provisioned by CaptivSite following a sales conversation and agreed pricing.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You may not share your account access with a third party outside your own organization without our written consent.
  • We may suspend or terminate access for non-payment, misuse, or violation of these Terms.

5. Acceptable use

You agree not to use the Service to:

  • Send unsolicited communications that violate applicable anti-spam, telemarketing, or data-protection laws (including but not limited to CAN-SPAM, CASL, GDPR, TCPA, or India's IT Act and DPDP Act, as applicable to your jurisdiction and your recipients' jurisdiction);
  • Resell, sublicense, or redistribute the underlying lead data in bulk to third parties outside your own client work;
  • Reverse-engineer, scrape, or attempt to extract the Service's underlying data infrastructure beyond normal product use;
  • Use the Service for any unlawful, harassing, fraudulent, or harmful purpose.

6. Data accuracy — no guarantee

Business contact information provided through the Service is aggregated from third-party and publicly available sources and may be incomplete, outdated, or inaccurate. Each lead is shown with a confidence indicator as a general guide only. CaptivSite does not guarantee the accuracy, completeness, or deliverability of any contact information, and you are responsible for verifying data before relying on it commercially.

7. Your responsibility for outreach compliance

You are solely responsible for ensuring that any outreach, marketing, or communication you conduct using data obtained through the Service complies with applicable law in your jurisdiction and the recipient's jurisdiction, including consent, opt-out, and data-handling requirements. CaptivSite is a data-discovery and organization tool; it is not a compliance or legal service.

8. Pricing, invoicing, and payment

  • Pricing is agreed individually with each Customer and is not published on the Service or website.
  • Payments are processed via Stripe, either through invoicing or recurring payment links, as agreed at signup.
  • Fees are non-refundable except where required by law or expressly agreed in writing.
  • Failure to pay may result in suspension or termination of access.

9. Third-party integrations

The Service may allow you to connect third-party tools (such as HubSpot or Zoho) to export or sync data. Your use of those third-party services is governed by their own terms, and CaptivSite is not responsible for their availability, security, or handling of your data once transferred.

10. Intellectual property

The Service, including its software, design, and branding, is owned by CaptivSite and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service itself; you retain rights to the data you export and any lists or content you create within your account.

11. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any lead generated will result in a sale or business outcome.

12. Limitation of liability

To the maximum extent permitted by law, CaptivSite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Termination

Either party may terminate access to the Service as agreed in your individual arrangement with CaptivSite. We may terminate immediately for breach of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active customers. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
